The Students / Clients are requested to provide and carry their Learner Permit / Overseas Licence (Original) while learning to drive.

The student must produce the appropriate Learner permit or other licenses before the commencement of every driving lesson and must always be in the student’s possession during the learning/teaching process.

The students/clients should provide their full address, contact mobile number and their email id for records purpose to the booking office or Instructors and fill in the enrolment form.

The lesson time starts once the instructor has arrived at the clients address or at the designated appointment time. In case the student turns up late that will be counted towards the lesson time. 

It is students responsibility to advise the school or the instructor in case he/she is having any (prescribed or not) medication that might affect the driving. All mobile phones should be turned off during the driving lesson or should be in silent mode.

Students must advise as early as possible if there is anything, which may impair their ability to learn in order that steps may be taken to overcome them. This could include difficulties in reading/writing or understanding English, colour blindness, sight or hearing impairment.

Skills will be assessed in a variety of ways, depending on the experience level and depth of learning. They are explained by the instructor and will be valid, reliable, fair and flexible. Assessments will be done through observation, question, and answer and through assignments which will be helpful for identifying areas of strength and areas of improvement.

Students will be assessed by also testing them in challenging situations in order to make them confident in their driving skills and attempt the driving test successfully.

Lessons are built up as per the ability, knowledge and driving experience of the learner driver and not as per individual preferences. 

Lessons will start and finish at the agreed booking location i.e. home address. Any alteration to pick up/drop off locations are not allowed and need to be agreed/approved by the driving instructor.

At no time we accept any rude, abusive or aggressive behaviour from the learner driver/clients towards our Driving Instructors/Staff. Any such behaviour will result in termination of the lessons/test/or future lesson packages. The matter will be investigated and the package might be treated as cancellation under such circumstances. Refunds and cancellations will be handled as per our cancellation policy.

*All packages are non-refundable (no change of mind) and must be used within three months of purchase.
**Packages to be used from Mon- Friday (8am -530pm) only and can not be substituted for Night Lessons/Freeway/Weekend Driving Lessons.
Weekend lessons with the packages are subject to availability. (extra charges apply)
Saturday/Sunday PH Lessons are $70/$80 per hr (exclusive of GST). Freeway/Night Driving lessons are $90/$80 per hour.

**** Any cancellation/rescheduling of lessons will need a 48 hour notice and 72 hour notice for the Drive Tests. Cancellation Charges apply.

****** By making a purchase, the client agrees to our terms and conditions and all policies and procedures. 

All Drive Test Packages & 5 Lesson Packages must be used within 2 months of purchase & 10 Lesson Packages within 3 months of date of purchase. Packages expire after that duration and are not refundable.

Demerit Points/Fines

 

Learner Driver is responsible for any fines/demerit points while driving the instructors vehicle. 

Although extreme care is taken while learners are doing the driving lessons and they are being informed immediately in case they overspeed, there is no guarantee that they won't get a speeding/red light or other fines.

We do keep a record of all the lessons (date/time) and when identified the fine will be transferred to the learner and the learner will be liable for the fine/demerit points.

Learner drivers are responsible of showing safe driving behaviour at all times which do include maintaining safe speed and obeying other road rules. 

Learner Driver is responsible for all fines/demerit points while doing the Driving Test/Driving Lessons.

 

 

Cancellation Policy (No Show) & Refunds

We understand that there will be a need to reschedule or alter Driving Lesson/Drive Test appointments from time to time. Please make all driving lesson/drive test cancellations and alterations by calling Safe N Smart Driving School or leaving a text message. Please give us as much notice as possible (check the notice periods mentioned below for the cancellation charges) and only make changes to the Drive Test dates/location after checking the availability of Driving Instructor. In case a Drive Test booking time or location is changed without communication and checking the availability of the allocated instructor (after the original booking is made), we might not be able to cover the Drive Test if the Instructor is already booked for that day. Any charges associated for rebooking will be covered by the client and no refunds can be issued for change of mind once the original booking is made with us. All the refunds requests are considered on individual merits depending on the individuals circumstances there by making a decision on whether the refund is eligible and the amount to be refunded. Please refer below for the rescheduling/cancellation fees associated wit the Lessons & Drive Test Packages.

Driving Lessons Package Cancellation & Refunds

​

At least 48 hours notice must be given to avoid a cancellation fee.

​

• Driving Lessons rescheduled less than 48 hours notice – 50% of scheduled lesson fee applies.

• Driving Lessons rescheduled less than 24 hours notice or not attended – 100% of scheduled lesson fee applies.

• Driving Lessons rescheduled over 48 hours notice - No Charge

• No show - 100% of scheduled lesson/test fee applies.

• Cancellation of Driving Lesson Packages after the package has started will incur a cancellation charge of 50% of the remaining balance calculated on the full price of the lesson. A service fees of $50 also applies to all cancellation of the driving lesson packages after the commencement of the package. No refunds can be made for change of mind, so please ensure you make a purchase only if you want to go ahead with the package. There is an option of booking one lesson at a time in case the learner is not sure about their commitment or want to try on the experience with Driving Instructor first before committing themselves to the package. Under some circumstances the Driving Lesson/Drive Test packages might be outsourced to other instructors/driving school if we are over occupied with the bookings. If the driving lesson/test package has already been outsourced to the Driving Instructor then the refunds process will be dealt by the client directly with the allocated Driving Instructor/Driving School. 

• Cancellation of Driving Lessons Package before the start for of the 1st lesson/package  - 1 Lesson Charge or $100 cancellation fees (whichever is greater) applies calculated on the full price of the lesson if more than 48 hours notice is given before the appointment and 2 Lesson Charges for notice period less than 48 hours. No refunds can be made for change of mind. 

• All Diving Lesson/Drive Test packages must be used within 3 months of purchase and the package expires if not used within that time period.

Driving Test Package Cancellation & Refunds

​

• Drive Test rescheduling/cancellation needs at least 72 hours of notice. Any rescheduling/cancellation done under 72 hours notice - 100 % of scheduled fee applies.

• Drive Test Booking cancelled between 72 hours to 7 days prior to booking date - 60% of the booking fees applies.

• Drive Test Booking cancelled 30 days - 7 days prior to booking date - 50% of booking fees applies. 

• Drive Test Booking cancelled 45 days -30 days prior to booking date - $100 service fees applies.

• Drive Test Booking cancelled more than 45 days prior to booking date - $50 service fees applies.

• Rescheduling fees of $50 applies for the Drive Tests for change of Date (subject to availability). In case a Drive Test booking time or location is changed without communication or checking the availability of the allocated instructor (after the original booking is made), we might not be able to cover the Drive Test if the Instructor is already booked for that day. Any charges associated for rebooking will be covered by the client and no refunds can be issued for change of mind once the original booking is made with us. Under some circumstances the Driving Lesson/Drive Test packages might be outsourced to other instructors/driving school if we are over occupied with the bookings. If the driving lesson/test package has already been outsourced to the Driving Instructor then the refunds process will be dealt by the client directly with the allocated Driving Instructor/Driving School. 

• Rescheduling fees applies for the change of drive test location/service centre. (Charges vary from location to location depending on the distance and service areas).

• No show - 100% of scheduled lesson/test fee applies.

• In case the Drive test does not go ahead on the day because of VicRoads regulations, hazard test not being completed, log book not accepted, incomplete documentation - 100% of the charges apply.

All Drive Test/Driving Lessons Packages are non-refundable (no change of mind). Appointments can be rescheduled with the notice period mentioned above. Please ensure to call us in case you have any doubts regarding the booking, prior to making a booking online. In case of change of date/location of the Drive Test appointment, do check the availability of instructors with us before locking in any dates. Additional charges apply for change of location/date of Drive Test if agreed upon by the driving instructor and is subject to availability. Charges do vary from location to location, so do consult us before you make any changes to the appointments. All Packages must be used within 3 months from the date of purchase.

 

Accident Policy

Being a learner driver does not take away your responsibility from the road rules and road safety.

​

While driving instructors strive to provide quality driver training and conduct assessments to required standards we must remember that all drivers are responsible for their own actions and decisions. No assurances are implied or given that drivers will remain collision free upon completion of any driver training or assessment program.

We also remind every client that it is the responsibility of all drivers to notify Department of Transport regarding any changes or medical concerns that may effect driving ability.

 

All drivers while taking driving lessons/drive test do take the responsibility of not being under the influence of alcohol/drugs or be fatigued. 

​

Although extreme care is taken and our instructors are well experienced to take control over challenging situations, there is no guarantee that accidents may not happen in any unforeseen circumstances.

In case of any accident the Learner Driver, if at fault will need to pay the excess for the insurance claim.

Excess need to be paid within 10 days of the days of accident even if the matter is still under investigation and no liability has been established.

In case the insurance investigations find the Learner Driver not to be at fault and excess is not applicable then the learner driver will be reimbursed for the payment made.

There will be extra excess for any drivers under the age of 25 years.

Excess amount may vary from year to year depending on the insurance policy structure.

Disclaimers

All drivers are responsible for their own actions and safety.

While driving instructors strive to provide quality driver training and conduct assessments to required standards we must remember that all drivers are responsible for their own actions and decisions. No assurances are implied or given that drivers will remain collision free upon completion of any driver training or assessment program.

We also remind every client that it is the responsibility of all drivers to notify Department of Transport regarding any changes or medical concerns that may effect driving ability.

Road law interpretations and advise

Please note that all descriptions and explanations of Road Laws and Road Rules are our interpretation only and are not to be considered as binding legal advice. Full legal wording and details can be found by referring to the Road Rules and Road Safety (Drivers) Regulations 2019 and at the VicRoads website.

Limitations

a).  Learner may have rights under the Australian Consumer Law, and nothing in this Limitations clause attempts to modify or exclude those rights.

b).  Despite anything to the contrary, to the maximum extent permitted by law:

• • Driving Instructor’s maximum aggregate liability arising from or in connection with the Terms (including the Driving Lessons and/or the subject matter of the Terms) will be limited to, and must not exceed, the portion of the Fees paid by Learner to Driving Instructor for the Driving Lesson the subject of the relevant claim; and

  • Driving Instructor will not be liable to Learner for any loss of profit (including anticipated profit), loss of benefit (including anticipated benefit), loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings (including anticipated savings), loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

c).  Despite anything to the contrary, to the maximum extent permitted by law, Driving Instructor will not be liable for, and Learner waives and releases Driving Instructor from and against any liability caused or contributed to by, arising from or connected with any event or circumstance which is beyond Driving Instructor’s reasonable control including but not limited to, acts of God including fire, hurricane, typhoon, earthquake, landslide, tsunami, mudslide or other catastrophic natural disaster, civil riot, civil rebellion, revolution, terrorism, insurrection, militarily usurped power, act of sabotage, act of a public enemy, war (whether declared or not) or other like hostilities, ionising radiation, contamination by radioactivity, nuclear, chemical or biological contamination, any widespread illness, quarantine or government sanctioned ordinance or shutdown, pandemic (including COVID-19 and any variations or mutations to this disease or illness) or epidemic.

d).  Despite anything to the contrary, to the maximum extent permitted by law, Driving Instructor will have no liability, and Learner releases and discharges Driving Instructor from all liability, arising from or in connection with any:

• • loss of, or damage to, the products, or any injury or loss to any person;

  • failure or delay in providing the products; or

  • breach of the Terms or any law,

where caused or contributed to by any:

• • event or circumstance beyond Driving Instructor’s reasonable control; or

  • act or omission of Learner.

Disputes

 

Safe N Smart Driving School will try and resolve each matter on individual merits and urgency. At all times we do take considerate efforts not to cause any inconvenience to any parties involved and the matter to be resolved amicably. Under any unforeseen circumstances and unresolved matters, neither party may commence court/legal proceedings relating to any dispute arising from, or in connection with, these terms without first meeting with the other party to seek (in good faith) to resolve that dispute.
